1. Introduction

These Terms of Service (“Terms”) govern access to and use of the AI Horse Agent platform and related services (collectively, the “Service”), operated by Horsense shop s.r.o., a company incorporated in the Czech Republic (“Company”, “we”, “our”, or “us”). The Service includes the AI Horse Agent search platform, related user accounts accessible through my.horsen.se, and integrations with the horses.sale marketplace and other services within the Horsense ecosystem.

By accessing or using the Service, creating an account, or purchasing any paid features, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Service.

2. Nature of the Service

  • AI Horse Agent is a technology platform designed to help horse buyers and sellers discover relevant opportunities across the internet.
  • The Service collects and analyzes publicly available information, presenting normalized results to help users identify relevant listings and requests more efficiently.
  • The platform acts as a search and aggregation tool, not a marketplace or broker.
  • Users are typically redirected to the original source of the listing or request for full details and direct contact.

3. Relationship with horses.sale and the Horsense ecosystem

  • AI Horse Agent is part of a broader ecosystem of digital tools developed by Horsense shop s.r.o. for the equestrian industry.
  • Listings from horses.sale may appear in search results alongside listings collected from other sources.
  • Use of horses.sale is governed by its own policies and terms.
  • Data and functionality may be integrated between related services to improve results and matching.

4. Automated processing and artificial intelligence

  • The Service uses automated data collection, algorithmic analysis, and AI to interpret and normalize listing information.
  • Classifications and estimates are generated automatically and may not always be accurate or complete.
  • Users should verify important details directly on the original listing page or with the seller.

5. Third-party content and responsibility

  • The Service aggregates and analyzes information from third-party sources, including websites and social media platforms.
  • The Company does not control or guarantee the accuracy, completeness, or continued availability of third-party content.
  • Original content remains the property of the respective owners and is available on the original website.
  • All communication, negotiation, or transaction occurs directly between users and third-party sellers or buyers.
  • The Company does not act as an agent or broker and does not verify the authenticity of listings unless explicitly stated.

6. User accounts

  • Certain features require users to create an account managed through my.horsen.se.
  • Authentication is provided through Auth0 and may use email/password or third-party providers.
  • Users are responsible for maintaining the confidentiality of their credentials and all activity through their account.
  • The Company may suspend or terminate accounts that violate these Terms or harm the platform or other users.

7. Pricing and paid features

  • The Service provides both free and paid functionality.
  • Free search results may display a limited number of matches and hide certain information.
  • Paid features allow users to unlock additional results and receive updates.
  • Payments are processed through Stripe; the Company does not store complete payment card information.
  • Payments for digital services are non-refundable once the paid feature has been activated, unless required by law.

8. Database rights and protection of the Service

  • The Company’s database and analytical outputs are proprietary intellectual property.
  • Users may access and use the Service for personal or internal business purposes only.
  • Systematic extraction, copying, scraping, or redistribution of data is prohibited without written authorization.

9. Limitation of liability

  • The Service is provided on an “as-is” basis without warranties of any kind.
  • The Company does not guarantee uninterrupted access or the accuracy of aggregated information.
  • The Company is not responsible for the actions of sellers, buyers, or third-party platforms, nor the outcome of any transaction.

10. Changes to the Service and Terms

  • The Company may modify the Service or these Terms at any time.
  • Revised Terms will be posted on the website and become effective upon publication.
  • Continued use of the Service after changes indicates acceptance of the updated Terms.

11. Governing law

  • These Terms are governed by the laws of the Czech Republic.
  • Disputes are subject to the jurisdiction of the courts of the Czech Republic.
